Following our Newsletter 3 on registration of Trademark in Myanmar, we would like to inform you that the Ministry of Commerce of Myanmar has issued the Notification No. 63/2020 announcing the Soft-Opening period for re-filing trademark in Myanmar will start on October 1st, 2020 under Section 93(a) of the Trademark Law. Under which, the following documents may be submitted to prove trademark’s prior rights or use in Myanmar:
a) Trademark in Myanmar previously registered at the Deeds and Documents Registration Office;
b) Certificate of the Trademark in Myanmar previously registered at the Deeds and Documents Registration Office (True copy);
c) Proof of the Trademark Notice posted in Newspapers or made known to the general public in Myanmar;
d) Proof of the Trademark in Myanmar being genuinely used within the State’s markets;
e) Proof of the marketing and promotion for such Trademark in Myanmar;
f) Tax receipts or payment receipts
g) If the current Trademark owner is not the original person that registered at Deeds and Documents Registration Office, proof of the Transfer of Rights or name change of the Trademark owner;
h) Other evidences.
However, the above-said Notification does not provide the official fees and relevant procedures of re-filing trademark in Myanmar. We will participate in the Consultation Meeting held by the Ministry of Commerce and provide you with further information as soon as possible.
