Beside purpose of registrability assessment, searching design in Vietnam mainly focuses on the following purposes: to determine whether you might get in trouble for selling or manufacturing a product and to obtain information about a competitor’s designs/pending design applications in an area of interest in the Vietnamese market, etc.
2. Types of searching design in Vietnam

• When reporting the design search result, we issue our additional professional opinion on the registrability based on the search result.
• A positive official search report can be used as a supporting document in case the Registry refuse the applied design, while unofficial search report does not have this function.
Un-Official Search: The design search report is expected to be available within 7-10 working days.
• The Search will be conducted by our Design Attorney then be approved by Partner;
• Our Search Report shows the Search Result includes an information on the found designs which are similar or not significantly different to the searched design and our professional opinion on the registrability based on the search result.
– Requirement: Set of drawings of searched design.
– The cost for conducting a prior art design search in Vietnam will depend on number of design.
2.3. Searching design in Vietnam by Names of Applicants or Proprietor
– Search database: Internal Database of National Office of Intellectual Property.
– Expected results: List of design/design application along with Bibliography information, status and a copy of drawings.
– Time frame: It would normally take around 7-10 working days from our receipt of the instruction.
2.4. Searching design in Vietnam by Drawings
– Search database: Internal Database of National Office of Intellectual Property.
– Expected results: List of designs/design application along with Bibliography information, status and a copy of drawings.
– Time frame: It would normally take around 7-10 working days from our receipt of the instruction for searching design in Vietnam.
2.5. Searching design in Vietnam by Locarno Classification
– Search database: Internal Database of National Office of Intellectual Property.
– Expected results: List of designs/design application along with Bibliography information, status and a copy of drawings.
