New choice for Chinese clients to register industrial design in Vietnam – China official joins the Hague system

According to the announcement of the World Intellectual Property Organization (WIPO), China has deposited its instrument of accession to the 1999 Geneva Act on February 05, 2022 meaning that it will officially enter force in China on May 05, 2022. This is a new choice for Chinese clients to register industrial design in Vietnam.

WIPO says that with China’s accession, the Hague System will now cover nine out of ten of the world’s top economic markets. As from May 05, 2022; non-residents will be able to seek for design protection in China, promoting the expansion of their businesses in one of the world’s largest markets.

In parallel, Chinese enterprises and designers will be able to quickly and easily secure design protection in as many of 94 countries covered by the Hague including Vietnam. In the context that the economic and commercial relations between Vietnam and China have expanded consistently and strongly, the bilateral trade turnover has increased significantly with the average growth rate in the last 5 years reaching over 20% per year. Along with this fact, the number of applications of industrial design in Vietnam filed by Chinese applicants also increases 15 to 20% per year, maintaining China’s position in the top 5 countries with the most industrial design applications filed to Vietnam, we trust that this number will increase remarkably in the following years.
