Since the international industrial design application can be designated to Vietnam in the end of 2019, the number of industrial design applications in Vietnam under Hague system has increased significantly, but this has also led to a rise in the rejection rate due to deficiencies. In this article, we will highlight the most common deficiencies and suggest ways to overcome refusals:
Common Deficiencies in Industrial Design Applications Designated Vietnam: How to overcome

How to overcome |
The description does not list all main appearance characteristics of the design; thus, the description does not fully disclose the design as required. |
This refusal may be overcome by submitting a corrected version of description to replace the current description. |
The reproductions illustrate the design in several states but none of these states include enough of required views. |
This refusal may be overcome by submitting the missing views and the description of the new set of reproductions. It must be noted that the new set of reproduction must not change the gist of the design. |
The registration contains different industrial designs which are not variant or a set of product, thus, it does not meet the requirement on the uniformity of industrial property registration applications. |
This refusal may be overcome if the holder submits a declaration to separate the registration into different registrations in Vietnam, each for one design. |
