The recordal of amendment of trademark in Cambodia shall be in writing and shall, at the request of any interested party, to the Registrar, be recorded and, published by the Registrar. Such changes shall have no effect against third parties until such recording is affected. It must get the approval from the Minister of Commerce first. It will be invalid if it is likely to deceive or cause confusion, particularly concerning the nature, origin, manufacturing process, and so on.
Any change in the ownership of name of a trademark in Cambodia must be made with the transfer of the enterprise or part thereof identified by that name and shall be in writing.
Amendment of trademark in Cambodia
1. Requirements for amendment of Trademark in Cambodia
Applications for certificates amendment of Trademark must be filed with the Department of Intellectual Property of Cambodia and the following documents are required:
(i) An original Notarized Power of Attorney (POA) in the applicant’s new name and/or address;
(ii) An original notarized Declaration reflecting the change of name and/or address;
(iii) Original current Certificate of trademark registration.
Please kindly be noted that:
- The notarization of POA and Declaration must be done at the country of Applicant;
- Under the current rules, the following paragraph in the POA & Declaration should be done even in case there is a specific form of each Notary Office:
“I hereby certify the above firm is a juristic person duly organized under the laws of ____________ and that the signature above is that of ____________(name), (title)_____________who is duly authorized to sign on behalf of the above-mentioned firm.”
It is compulsory that the original documents must be submitted at the filing time of the amendment of Trademark in Cambodia.
2. Cost for amendment of Trademark in Cambodia
The package cost including both official fees and all inclusive attorney’s and disbursement for the recordal of change of registrant’s name and/or address of one registration in one class.
3. Time frame
It takes approximately 5 months from the filing date to complete the recordal of change of name and/or address.
